What is your personal and health information used for?
Aetas Diagnostics obtains and processes personal and health information from individuals as part of our diagnostic, prognostic, clinical and scientific tasks, as well as our sales and marketing efforts. Personal and health information about individuals will therefore be processed when you contact us or become a customer of Aetas Diagnostics.
The following policy applies to the processing of personal and health information that takes place in connection with the Aetas Diagnostics website, the performance of biological analyses, treatments as well as any inquiries addressed to Aetas Diagnostics.
When processing personal and health information that takes place in other systems for which Aetas Diagnostics is the data controller, please refer to the separate information texts.
When you as a private person or company visit the Aetas Diagnostics website, cookies are used for statistical purposes in order to create an overview of how many visitors there are on the website and which parts of the website are visited.
Aetas diagnostics processes personal data about you in connection with inquiries and in connection with diagnostic tasks, treatments and other health services that concern you or your company.
When you write to us, or enter into an agreement to carry out diagnostics and biological analyses, your inquiry and your personal and health information will be registered in our electronic case and document management system and electronic health record system. You will also receive electronic correspondence from us in the form of emails. If you wish to unsubscribe from newsletters, you can always do so by clicking "unsubscribe" in the bottom of the email.
When you buy treatments and analysis from Aetas Diagnostics, information will be collected in the form of name, email, phone number biological sex, address, contact information and CPR number, as well as information about the specific inquiry, diagnosis and treatment, your biological and genetic data information. We process and store this information securely and encrypted according to GDPR regulations, the Danish Health Act and the Record-keeping Order. We will retrieve medical information about our clients for our assessments. This means that our medical staff will access and retrieve your medical records.
When you become a client of Aetas Diagnostics, an encrypted electronic health record is created and stored on our secure servers with your data in it. We use the data in it for our precision analysis, so we can provide the best possible clinical health advice tailored to you. Your data, along with our other clients data, large-scale population and clinical databases makes this possible. It allows us to do real-time scientific research, and translate that into evidence-based and easily-understandable personal health recommendations for you. When you become a client of Aetas Diagnostics, you agree that your medical data will accessed, obtained and used for scientific research, and in the clinical practice, to provide best treatment options for you and our other clients.
Legal basis
The legal basis for the processing of your information in connection with the newsletter follows from the data protection regulation, article 6, subsection 1, letter a – consent.
The legal basis for the processing of your information in connection with the necessary collection of data for carrying out biological analyses follows from the data protection regulation, article 6, subsection 1, letter f – legitimate interest in carrying out biological analyses, in documenting correct handling of process and compliance with legislation, scientific research, and clinical practice as a legitimate interest in providing you with a test result, interpretation and health advice.
The legal basis for the processing of your information in connection with the patient record follows from the data protection regulation, article 6, subsection 6(1)(c) – legal obligation and 9(2 9(2)(h) – medical diagnosis and treatment, Consent as described in the Health Act, §15(1) and the Record-keeping Order, §15(1).
The legal basis for the processing of your information in connection with the transfer of data to the Danish public healthcare system, and Agency for Patient Safety and the Statens Serum Institut follows from the data protection regulation article 6(1)(c) – legal obligation and 9(2)(i) public interest in the field of public health.

For processing based on consent, you have the right to withdraw your consent, but this will not affect the processing that has already taken place before withdrawal of consent.

Categories of personal and health information
Regarding general personal data in connection with inquiries, Aetas Diagnostics will process your name, contact details and the personal data you provide in the inquiry.
Special personal data (health information) in connection with the performance of biological analyses, Aetas Diagnostics will process your name, and the personal and health information necessary for the performance of the biological analysis, including email, cell phone number, address, CPR number, date of birth, biological sex, medical history and other relevant health information, including questionnaires, the result of your test(s), biological data, infection status, genetic data, diagnosis and prognosis and medical prescriptions.
Are there other recipients of your information?
Aetas Diagnostics transfers health data to your treating physician, and the public health record system. The data will be limited to only the personal and health information that is necessary and required as part of the correct performance of our specific clinical and diagnostic tasks for you or your company.
In addition, Aetas Diagnostics transfers biological samples to our partner laboratories for analysis, and information to our external data processors which analyse data for us, and host our clinical and scientific software, and our Electronic Medical Record systems. Anonymised data will be used internally for scientific research, as well as for internal and external quality control.
We do not sell, license or distribute you data to anyone, except the controlled and secure transfer to our collaboration partners, entities and data processors for which we have legitimate purposes for your correct treatment and analysis, and only when we have reliable data sharing agreements in place, for the sole purpose of giving you the best possible treatment and precise diagnostic advice.
Genetic Analysis
For all genetic analysis, separate consent agreement are always obtained. Before deciding to do a genetic analysis, always consider throughly 1) the impact and ethical considerations a genetic analysis can have for yourselve and 2) The impact and ethical consequences it can have unintended on family members that might not have wished to receive information, that might be given to them by yourselve in connection with a finding, and 3) If you wish to receive infomatiomn on secondary findings. You will always be asked both verbally and in writing, separately from this privacy policy, before any genetic analysis, to decide on these three important questions. If you change your mind after the fact, you can always contact us and change your opinion, in the cases where its still possible.
Biological samples
Biological samples transferred, as a main rule is always discarded safely after ended analysis, except in certain cases where we will keep samples for a shorter period of time for the purpose of re-analysing it without having to take out new samples. In some cases we will ask if we can keep your sample for our biobank, if we have specific ongoing scientific studies. You will always be asked clearly and separately and can always say no, if you do not want to participate in these studies.
Transfer to recipients in third countries, including international organizations
We transfer your personal data to recipients outside the EU and EEA if necessary for your treatment and analysis of results. This includes laboratories, clinics, and hospitals, as well as external data processors located in England, USA, and Switzerland. The category of information includes sensitive personal data and health information, biological and scientific information obtained or generated through treatment, examination, and analysis. For England and Switzerland, The EU Commission has made a decision regarding the adequacy of the level of protection in these countries, ensuring that your data is securely stored and handled according to applicable rules. For USA, the same applies, though it applies to entities that observe GDPR compliance rules, or have entered into EU-US Data Privacy Framework agreements. You can always ask us to obtain a copy of the procedures and certification for these entities.
How long we store your information
Aetas Diagnostics only stores and processes your personal and health information as long as it is necessary and required in relation to the stated purposes. In some areas, there is also a statutory deadline for how long personal and health information must be stored. In those cases, a decision has been made by law, as to how long there is a purpose for storing and processing the personal and health information. When the purpose of the processing is no longer present, your personal and health information will be deleted, anonymized or transferred to an archive in accordance with the rules in archive legislation.
You're data is safe with us
When we receive your information at Aetas Diagnostics, we take the necessary measures to ensure that it is processed securely. We have implemented a number of technical and organizational security measures which protect against accidental or illegal destruction as well as loss or deterioration of information. In addition, measures have been taken to ensure that your information does not come into the posession of unauthorized persons, and is not misused or otherwise processed in violation of the data protection regulation. Please note that sending regular email to Aetas Diagnostics is not encrypted. Please use mit.dk or other encrypted mail if you want to send personal health information to us.
Your data is always transferred and stored in a safe encrypted format, in certified and GDPR and HIPAA compliant medical EMR systems and portals, scientific data analysis pipelines, with SLL and AES256 encrypted data transfer and storage. Only authorised personel has access to it. Your data is never shared with anyone else without your consent.
Your rights
You have a number of rights in relation to the processing of your personal and health information by Aetas Diagnostics.

Retsgrundlaget for behandlingen af dine oplysninger i forbindelse med patientjournalen følger af databeskyttelsesforordningens artikel 6, stk 6(1)(c) – juridisk forpligtelse og 9(2 9(2)(h) – medicinsk diagnose og behandling, Samtykke som beskrevet i Sundhedsloven, §15(1) samt Journalføringsbekendtgørelsen, §15(1).

B) Vi har interesse i at dokumentere dine oplysninger, så vi kan overholde gældende love og regler.
For behandling baseret på samtykke har du ret til at trække dit samtykke tilbage, men dette vil ikke påvirke behandlingen, der allerede har fundet sted inden tilbagekaldelse af samtykket.

Kategorier af person- og sundhedsoplysninger
Med hensyn til generelle personoplysninger i forbindelse med forespørgsler vil Aetas Diagnostics behandle dit navn, kontaktoplysninger og de personoplysninger, du giver i forespørgslen.
Særlige personoplysninger (sundhedsoplysninger) i forbindelse med udførelsen af biologiske analyser, vil Aetas Diagnostics behandle dit navn, cpr-nummer, adresse, e-mail, telefon nummer, fødselsdato, biologisk køn, medicinsk historie, og de person- og sundhedsoplysninger, der er nødvendige for udførelsen af behandling og de biologiske analyser, herunder andre relevante sundhedsoplysninger, samt resultaterne af dine test, biologiske data, infektionsstatus og genetiske data, diagnose, prognose og medicinske recepter.
Genetiske analyser
For alle genetiske analyser indhentes altid separat samtykkeaftale. Inden du beslutter dig for at foretage en genetisk analyse, bør du altid grundigt overveje: 1) den påvirkning og de konsekvenser en genetisk analyse kan have for dig selv, og 2) den påvirkning og de etiske konsekvenser, den utilsigtet kan have på familiemedlemmer, der måske ikke ønsker at modtage information, som du måtte give dem i forbindelse med en fund, samt 3) om du ønsker at modtage information om sekundære fund. Du vil altid blive bedt både mundtligt og skriftligt, separat fra denne privatlivspolitik, inden enhver genetisk analyse, om at træffe beslutning om disse tre vigtige spørgsmål. Hvis du ændrer mening efterfølgende, kan du altid kontakte os og ændre din holdning, i de tilfælde hvor det stadig er muligt.
Er der andre modtagere af dine oplysninger?
Aetas Diagnostics overfører sundhedsdata til din behandlende læge og det offentlige sundhedsjournalssystem. Data vil kun være begrænset til personlige og sundhedsoplysninger, der er nødvendige og påkrævede som en del af korrekt udførelse af vores specifikke kliniske og diagnostiske opgaver for dig eller din virksomhed.
Derudover overfører Aetas Diagnostics biologiske prøver til vores samarbejdslaboratorier til analyse og information til vores eksterne databehandlere, som analyserer data for os og hoster vores kliniske og videnskabelige software samt vores Elektroniske Patientjournal-systemer. Anonymiserede data vil blive brugt internt til videnskabelig forskning samt til intern og ekstern kvalitetskontrol.
Vi sælger, licenserer eller distribuerer ikke dine data til nogen, undtagen i kontrollerede og sikre overførsler til vores samarbejdspartnere, enheder og databehandlere, hvor vi har legitime formål for din korrekte behandling og analyse, og kun når vi har pålidelige datadelingsaftaler på plads, udelukkende med det formål at give dig den bedst mulige behandling og præcise diagnostiske rådgivning.
Biologiske prøver
Biologiske prøver, der overføres, bliver som hovedregel altid forsvarligt kasseret efter afsluttet analyse, undtagen i visse tilfælde, hvor vi vil beholde prøverne i en kortere periode med det formål at genanalysere dem uden at skulle tage nye prøver. I nogle tilfælde vil vi spørge, om vi kan beholde din prøve til vores biobank, hvis vi har specifikke igangværende videnskabelige studier. Du vil altid blive spurgt klart og separat og kan altid sige nej, hvis du ikke ønsker at deltage i disse studier.
Overførsel til modtagere i tredjelande, herunder internationale organisationer
Vi overfører dine personoplysninger til modtagere uden for EU og EØS, hvis det er nødvendigt for din behandling og analyse af resultaterne. Dette inkluderer laboratorier, klinikker og hospitaler samt eksterne databehandlere placeret i England, USA og Schweiz. Kategorien af oplysninger inkluderer følsomme personoplysninger og sundhedsoplysninger, biologiske og videnskabelige oplysninger, der er opnået eller genereret gennem behandling, undersøgelse og analyse. Hvor længe opbevarer vi dine oplysninger?
Aetas Diagnostics opbevarer kun dine person- og sundhedsoplysninger, så længe det er nødvendigt og påkrævet i forbindelse med de angivne formål. På visse områder er der også en lovbestemt frist for, hvor længe person- og sundhedsoplysninger skal opbevares. I disse tilfælde er der truffet en beslutning ved lov om, hvor længe der er et formål med at opbevare og behandle person- og sundhedsoplysninger. Når formålet med behandlingen ikke længere er til stede, vil dine person- og sundhedsoplysninger blive slettet, anonymiseret eller overført til et arkiv i overensstemmelse med reglerne i arkivlovgivningen.

Når vi modtager dine oplysninger hos Aetas Diagnostics, træffer vi de nødvendige foranstaltninger for at sikre, at de behandles sikkert. Vi har implementeret en række tekniske og organisatoriske sikkerhedsforanstaltninger, der beskytter mod utilsigtet eller ulovlig ødelæggelse samt tab eller forringelse af information. Dine data bliver altid overført og opbevaret i en sikker krypteret format, i certificerede og GDPR- og HIPAA-kompatible medicinske EMR-systemer og portaler, videnskabelige dataanalyse pipelines, med SSL og AES256 krypteret dataoverførsel og -opbevaring. Kun autoriseret personale har adgang til det. Dine data deles aldrig med nogen uden dit samtykke.
